We take a collaborative approach to these meetings because we think it is more effective than being adversarial. But if we are unable to reach agreement, we file for due process.

Due Process Hearings

As the parent of a child in special education, you have the right to appeal any dispute you have with your child's school district to a neutral third party for resolution in a due process hearing. This procedure is essentially the special education equivalent of a formal trial, where evidence and facts are formally presented. Our attorney has a good success rate with these proceedings because she is respected by the attorneys for the school districts. They know if we file for due process it is because we believe we have a case, and as a result they are more likely to give us what we ask for to reach a suitable compromise.
