But if we are unable to reach agreement, we file for due process. Due Process Hearings As the parent of a child in special education, you have the right to appeal any dispute you have with your child's school district to a neutral third party for resolution in a due process hearing. This procedure is essentially the special education equivalent of a formal trial, where evidence and facts are formally presented.
